These terms and conditions of use (“Terms of Use”) govern your use of our online interfaces and properties (e.g., websites and mobile applications) owned and controlled by MEDIFY SYSTEMS, a unit of INSPIRATE TECHNOLOGIES PRIVATE LIMITED. (“MEDIFY”), including the www.medify.co.in website (the “Site”) and the services available to users through the Site (“Services” and “Platform”). For the purpose of this document a ‘Registered Medical Practitioner’ henceforth referred as RMP is defined as a person who is enrolled in the State Medical Register or the Indian Medical Register under the IMC Act 1956. All users inclusive of RMP, Patient, Health worker will be hereon referred as (“USERS”) henceforth. Compliance with these Terms of Use is a mandatory condition to use the Site. If any User does not agree to be bound by the Terms of Use, promptly exit this Site. Please refer our Privacy Policy on collection and handling of health and financial information.

Medify has been constructed with the base intent of proving telemedical technology for RMPs, Doctors, Health Workers, etc., to give an opportunity to patients to consult online (via the internet) at trying times such as an endemic, pandemic, geriatric, infectious disease, and other such not limiting to only – to receive the best available medical care to overcome the situation.

We DO NOT recommend Medify to be the best option for patients who require physical examination attention and emergency care.

Guidelines for consultation for immediate assistance or first aid etc.

  • In case alternative care is not present, and if tele-consultation might be the only way to provide timely care; in such situations, RMPs may provide consultation on the basis of their best judgement. Telemedicine services should however be avoided for emergency care when alternative in-person care is available, and telemedicine consultation should be limited to first aid, life-saving suggestions, counseling, second opinion and advice on referral
  • In all cases of emergency, the patient must be advised for an in-person interaction with an RMP at the earliest.

    MEDIFY does not hire or provide any RMPs’ or other providers’ and is only a platform that services RMPs’, patients and any other user type:

  • All the providers are independent of MEDIFY and use the Service to communicate with patients.
  • Any information or advice received from an RMP provider comes from the users and their opinions alone, and not from MEDIFY. MEDIFY doesn’t endorse the same.
  • All interactions with the providers via the Service are not intended to take the place of a real relationship with a regular health care practitioner.
  • Neither MEDIFY, nor any of its subsidiaries or affiliates or any third party who may promote the Service or provide a link to the Service, shall be responsible or liable for any professional advice obtained from a health care provider via the Service or for any other information obtained on the website.
  • MEDIFY does not endorse any specific tests, physicians, medications, products or procedures that are recommended by providers that may use MEDIFY to communicate with you.
  • You acknowledge that your reliance on any healthcare providers or information provided by the providers via the Service is solely at your own risk and you assume full responsibility for all risk associated herewith.
  • No claim shall be lodged against Medify for any deficiency of service rendered by the RMP
  • Medify shall not be responsible if the same could not function due to server/network/service outage by the service providers of Medify
  • No claim shall be entertained by Medify for any deficiency of service rendered by the RMP or on the medicines/tests prescribed by the RMP
  • Medify shall not be used for any other business transaction knowingly or unknowingly either by the RMP or by the patient. If in case, it is used, it would become a breach, and either party is liable to Medify for compensation
  • Medify shall share data of the RMPS and patients as is required by the local governing law as much as is not confidential to the individual

MEDIFY does not make any representations or warranties about the training or skill of any healthcare providers who provide services via the Service or Platform. Users are ultimately responsible for choosing any healthcare provider. MEDIFY conducts their due diligence before listing any RMP /Healthcare provider on its Website. MEDIFY displays the RMPs’ / Healthcare Providers’ name, qualification and registration number, contact details or any such information provided during registration, of every RMP / Healthcare provider on the Website.

The Terms & condition is published in compliance of, and is governed by the provisions of Indian law, including but not limited to:

  • The Indian Contract Act, 1872,
  • The (Indian) Information Technology Act, 2000, and
  • The rules, regulations, guidelines and clarifications framed there under, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”), and the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 (the “IG Rules”).

All pages within this Site and any material made available for download are the property of MEDIFY, or its licensors or suppliers, as applicable. The Site is protected by Indian and International Copyright and Trademark Laws.

Conditions of Use

You must be 18 years of age or older to register, use the Services, or visit or MEDIFY in any manner. By registering, visiting and using MEDIFY or accepting this Terms & Condition, you represent and warrant to MEDIFY that you are 18 years of age or older, and that you have the right, authority and capacity to use the Website and the Services available through the Website and agree to and abide by this Terms & Condition.

Electronics Communication

Telemedicine includes all channels of communication with the patient that leverage Information Technology platforms, including Voice, Audio, Video, Text & Digital Data exchange. When you use any MEDIFY Service, or send e-mails, text messages, and other communications from your desktop or mobile device, you are communicating electronically. You consent to receive communications electronically. You agree that

(a) all agreements and consents can be signed electronically and

(b) all notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such notices and other communications be in writing. Irrespective of the tool of communication used, the core principles of telemedicine practice remain the same.

The professional judgment of a Registered Medical Practitioner should be the guiding principle for consultations: RMPs / healthcare providers are well positioned to decide whether MEDIFY consultation is sufficient, or an in-person review is needed. RMPs / healthcare providers shall exercise proper discretion and not compromise on the quality of care.

RMPs’ / Healthcare - Information, Consent & Privacy

MEDIFY collects RMPs’/Healthcare providers’ name, contact information, Medical Registration number, qualifications/credentials, bank details, location of practice, PAN card and any such personal directly or indirectly, and displays on the Website. If RMPs’/Healthcare providers’ submit name, contact information, Medical Registration number, qualifications/credentials, bank details, location of practice, PAN card to MEDIFY (“RMP / Healthcare Information”), you agree not to provide any RMP / Healthcare Information that (1) is false, inaccurate, defamatory, abusive, libelous, unlawful, obscene, threatening, harassing, fraudulent, pornographic, or harmful, or that could encourage criminal or unethical behavior, (2) violates or infringes the privacy, copyright, trademark, trade dress, trade secrets or intellectual property rights of any person or entity, or (3) contains or transmits a virus or any other harmful component. Relevant information provided regarding the profile and practice of the RMPs /Healthcare providers, such as specialization, Medical Registration number etc., will be displayed on the Website, MEDIFY takes efforts to ensure that such information is updated at if any information requires an update. Although MEDIFY screens and vets the information and photos submitted by the RMPs /Healthcare providers, it cannot be held liable for any inaccuracies or incompleteness represented from it, despite such reasonable efforts.

If MEDIFY determines that you have provided fraudulent, inaccurate, or incomplete information, during the background verification, MEDIFY reserves the right to immediately suspend access to the Website or any of your accounts with MEDIFY and report the same to BoG, in supersession to MCI who may take appropriate action. MEDIFY RMPs / healthcare providers do not provide for consultations outside the jurisdiction of India. RMPs / Healthcare providers using MEDIFY shall follow and practice the same professional and ethical norms and standards as applicable to traditional in-person care, within the intrinsic limitations of telemedicine. RMPs using telemedicine shall uphold the same professional and ethical norms and standards as applicable to traditional in-person care, within the intrinsic limitations of telemedicine. A RMP / Healthcare provider is well positioned to decide whether a technology-based consultation is sufficient or an in-person review is needed. RMPs / Healthcare providers not to comprise on the quality of care and at their discretion. RMPs / Healthcare providers can choose to accept, cancel or reschedule a Service for a particular user, MEDIFY has no control over that decision of the RMPs / Healthcare.

MEDIFY will display information of the Users’ and the RMPs’ / Healthcare providers’ to each other from the time of requesting a Service until the completion. RMPs / Healthcare provider should verify and confirm patient’s identity by name, age, address, email ID, phone number, or any other identification as may be deemed to be appropriate. Users will also have the information of the RMP / Healthcare service at Service displayed by MEDIFY. RMP / Healthcare provider should obtain the User’s informed consent before or during the Service. RMPs / Healthcare provider can choose to provide Service in MEDIFY irrespective of the date and time of appointment.

For issuing a prescription, the RMP needs to explicitly ask the age of the User, and if there is any doubt, seek age proof. Where the User is a minor, after confirming the age, Service in MEDIFY would be allowed only if User is consulting along-with a Care giver whose identity needs to be ascertained.

MEDIFY will display every RMPs’ / Healthcare providers’ details provided such as the registration number accorded to on prescriptions, website, electronic communication (SMS/ email etc.) and receipts etc., shared to User

MEDIFY does not endorse on Artificial Intelligence/Machine Learning to provide Service to the Users or prescribe any medicines to Users. Only a RMP / Healthcare provider is entitled to provide Service to the User.

RMPs / Healthcare providers during the Service, may proceed with a professional judgement to Provide Health Education as appropriate in the case; and/or Provide Counseling related to specific clinical condition; and/or Prescribe Medicines (“Prescription”).Prescription after the Service is at the professional discretion of the RMP / Healthcare provider and MEDIFY in not responsible. RMP / Healthcare provider should provide Prescription with the same professional accountability as in the traditional in-person Service. If a User requires a particular protocol to diagnose and prescribe as in a case of in-person consult then same prevailing principle will be applicable to a telemedicine consult. RMP / Healthcare provider prescribing via MEDIFY should do so as laid out by the Telemedicine Practice Guidelines by the Indian Central Government.

RMPs /Healthcare Provider providing Service through MEDIFY should not prescribe medicines in Prohibited List. Prohibited List have medicine listed in Schedule X of Drug and Cosmetic Act and Rules or any Narcotic and Psychotropic substance listed in the Narcotic Drugs and Psychotropic Substances, Act, 1985. (Refer TABLE here.)

In MEDIFY, a Service for a User is completed only when the RMP / Healthcare provider chooses to “Complete Consultation” at the end of the Service. RMPs / Healthcare providers fix the Service fee for each User using their sole discretion and MEDIFY has no direct or indirect influence on the same. RMPs / Healthcare can and may charge a “Registration fee” for the first consult, which is also solely decided by RMPs/Healthcare providers.

Users - Information, Consent & Privacy

MEDIFY collects Users’ name, contact information, age, gender, any such personal directly or indirectly (“User Information”), and disclose the User information to the respective RMP / Healthcare provider. If Users submit, upload, post or transmit any health information, medical history, conditions, problems, symptoms, personal information, files, videos, images or other materials to MEDIFY (“User Information”), you agree not to provide any User Information that

  1. is false, inaccurate, defamatory, abusive, libelous, unlawful, obscene, threatening, harassing, fraudulent, pornographic, or harmful, or that could encourage criminal or unethical behavior,
  2. violates or infringes the privacy, copyright, trademark, trade dress, trade secrets or intellectual property rights of any person or entity, or
  3. contains or transmits a virus or any other harmful component.

Users have the option of uploading one’s identifiable health information including physical, physiological and mental health condition, and medical records and history on the Application which may be accessed by RMP’s and/or other providers’ using MEDIFY, during the course of providing Services to users. If a User is a Secondary User (as designated by an RMP or a patient), Second User’s information may be provided to Us by the Primary User using and accessing MEDIFY. If Secondary User has not lawfully authorized the Primary User to do so, kindly reach out to us immediately at help@medify.co.in. By continuing to access and use MEDIFY, You confirm that You as a Secondary User have authorized Primary User to provide Your information to us and on the basis of information provided by the Primary User, RMPs and/or healthcare providers would generate the prescription in the Secondary User’s name.

We may collect various personal information from Users when You use MEDIFY. Our Privacy Policy sets out terms with respect to the collection, storage, use, processing, transfer and disclosure of any such personal information.

When User provides personal information in MEDIFY and click on the ‘Submit’ button at the time of scheduling an appointment, users specifically consent to Our Privacy Policy, Usage Policy and Terms & Conditions.

MEDIFY does not make any representations or warranties about the training or skill of any RMPs / Healthcare providers who provide services via the Service. Users are ultimately responsible and have a choice for choosing your particular RMPs/ Healthcare providers and to have the Service.

MEDIFY will display information of the Users’ and the RMPs’ / Healthcare providers to each other from the time of requesting a Service until the completion. RMPs / Healthcare provider should verify and confirm patient’s identity by name, age, address, email ID, phone number, or any other identification as may be deemed to be appropriate. Users will also have the information of the RMP / Healthcare service at Service displayed by MEDIFY.

In MEDIFY, RMPs / Healthcare providers would use his/her professional discretion to gather the type and extent of Users’ information (history/examination findings/Investigation reports/past records etc.) required to be able to exercise proper clinical judgement. This information can be supplemented through the Service with RMPs / Healthcare providers and by any information supported by technology-based tools. Further, RMPs / Healthcare providers may themselves have to access Users’ medical information (medical records, consultation history, transcripts etc.) in order to investigate any deficiencies, complaints or grievances that You bring to the notice of RMPs / Healthcare providers during the Service. You hereby specifically authorize RMPs / Healthcare providers to access Your medical information in such cases. RMPs / Healthcare providers are required to abide by Principles of medical ethics, including professional norms for protecting patient privacy and confidentiality as per IMC Act. MEDIFY assures to take Users’ privacy seriously and to maintain privacy and confidentiality of the information provided by Users to MEDIFY. MEDIFY, however, do not represent, warrant or guarantee that unauthorized access to your personal information is fool proof.

Primary User must be 18 years of age or older to register, use the Services, or visit or MEDIFY/ www.medify.co.in, in any manner. If Secondary User (Patient) is below 18 years, to use the Service, the user will need a “Caregiver” could be a family member, or any person authorized by the patient to represent the User. If User is incapacitated, for example, in medical conditions like dementia or physical disability etc., the care giver is deemed to be authorized to consult on behalf of the Secondary User and has to be present with the Primary User during the Service.

Users are ultimately responsible and have a choice for choosing your particular RMPs / Healthcare providers and to have the Service. MEDIFY conduct their due diligence before listing any RMP /Healthcare provider on its Website. MEDIFY provides the name, qualification and registration number, contact details or any such information provided during registration, of every RMP / Healthcare provider on the Website.

RMPs / Healthcare providers are required to abide by Principles of medical ethics, including professional norms for protecting patient privacy and confidentiality as per IMC Act. You hereby specifically authorize RMPs / Healthcare providers to access Your medical information in such cases.

Accuracy and Integrity of Information

MEDIFY attempts to ensure the integrity and accurateness of the website, it makes no representations, warranties or guarantees whatsoever as to the correctness or accuracy of the Website and Content thereon. It is possible that the Site could include typographical errors, inaccuracies or other errors, and that unauthorized additions, deletions and alterations could be made to the website. If an inaccuracy arises, please inform MEDIFY so that it can be corrected. Information contained on MEDIFY may be changed or updated without notice.

Termination

  • MEDIFY reserves the right to suspend or terminate a User’s access to the Website and the Services with or without notice and to exercise any other remedy available under law, in cases where,
  • Such User breaches any Terms & Conditions.
  • MEDIFY is unable to verify or authenticate any information provide to MEDIFY by RMPS / Healthcare providers;
  • MEDIFY has reasonable grounds for suspecting any illegal, fraudulent or abusive activity on part of such User; or
  • MEDIFY believes in its sole discretion that RMPs’ / Healthcare providers’ actions may cause legal liability for such User, other Users or for MEDIFY or are contrary to the interests of the Website.
  • Once temporarily suspended, indefinitely suspended or terminated, the RMPs / Healthcare providers may not continue to use MEDIFY under the same account, or a different account or re-register under a new account. On termination of an account due to the reasons mentioned herein, such RMPs / Healthcare providers shall no longer have access to data, messages, files and other material kept on MEDIFY by such Users. The RMPs / Healthcare providers shall ensure that he/she/it has continuous backup of any medical services the User has rendered in order to comply with the User’s record keeping process and practices.

  • MEDIFY does not replace the existing primary care physician-patient relationship.
  • MEDIFY operates subject to Indian Medical Act 1956.
  • MEDIFY RMPs / healthcare providers do not provide for consultations outside the jurisdiction of India.
  • MEDIFY does not guarantee that a prescription will be written or assigned for each consultation.
  • MEDIFY is not an Insurance product or a prescription fulfillment warehouse.
  • MEDIFY physicians do not prescribe controlled substances, non-therapeutic drugs and certain other drugs which may be harmful because of their potential for abuse.
  • MEDIFY RMPs / healthcare providers reserve the right to deny care for potential misuse of services.

Applicable Law and Dispute Settlement

  • You agree that this Terms & Condition and any contractual obligation between MEDIFY and User will be governed by the laws of India.
  • Any dispute, claim or controversy arising out of or relating to this Terms & Condition, including the determination of the scope or applicability of this to Terms & Condition iterate, or your use of MEDIFY or the Services or information to which it gives access, shall be determined by arbitration in India, before a sole arbitrator appointed by MEDIFY. Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat of such arbitration shall be Chennai. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the parties to the dispute.
  • Subject to the above Clause, the courts at Chennai shall have exclusive jurisdiction over any disputes arising out of or in relation to this Agreement, your use of MEDIFY or the Services or the information to which it gives access.

Right to Modify Revisions; General

MEDIFY reserves the right to modify these Terms & Conditions at any time, effective upon posting. Any use of this website after such changes will be deemed an acceptance of those changes. You agree to review the Terms of Use each time you access this website so that you may be aware of any changes to these Terms. MEDIFY uses Google Analytics, a third-party tracking service, which uses cookies to track non-personal identifiable information about our visitors to our main site in the aggregate to capture usage and volume statistics. MEDIFY has no access to or control over these cookies. The companion Privacy Policy covers the use of cookies by MEDIFY only and does not cover the use of cookies by any third-party. MEDIFY reserves the right, in its sole discretion, to terminate your access to all or part of this Site, with or without cause, and with or without notice. In the event that any of the Terms of Use are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Terms of Use shall otherwise remain in full force and effect.
